The 9th Amendment to the Consitution of the United States.

Today, after reading perhaps the most exhaustive law review of the 9th amendment to the Constitution of the United States, I sent the following letter to the Attorney General of the state of Colorado. In addition to the letter, I sent a copy of the referenced law review in support of my request.

Here is the text of my email:

Sir,

First, I applaud you for joining the efforts of other states to challenge the new Health Care law under the 10th amendment to the Constitution.

While I applaud this effort, I am convinced that "we the people" have a better constitutional challenge to this bill.

You will find attached to this email, a complete law review of the 9th amendment, as it applies to the people of the United States. Based on the text of the amendment, and the attached law review, I believe that this bill violates my constitutional unalienable right to refuse to purchase the health insurance product. Based on the current rules governing insurance, in regards to Commerce regulation, I believe that insurance in any form, cannot be debated as being a product.

While I also agree with the constitutional argument under the same amendment, that citizens have a right to purchase this product, I believe that the government does not have the privilege of infringing upon my rights to regulate to converse right to purchase. Had Congress separated the issues, those that feel that purchasing is their right would have had their constitutional right enforced. The bill of rights, however, specifically defends all rights of the people equally, and denies Congress the ability to deny or disparage my rights.

The powers that be, have largely ignored this amendment, as it is extremely inconvenient to them when placed in context of the debates that led it to be included in the bill of rights. I feel that, as this amendment has not historically been reviewed, it is time for the American people to prove that this amendment was written as our veto. I believe that the attached document, which constitutes perhaps the most exhaustive law review of the 9th amendment, will provide, through the words of the drafters of the bill of rights, adequate precedent to assure success in this constitutional challenge to the health care law.

Chris Matthews of MSNBC vs. the AG of Nebraska

So, this morning, while the Attorney General of Nebraska, certainly could have fared better in his arguments about the constitutionality of the new health care bill when faced off with Mr. Matthews.  However, I feel that Mr. Matthews is first and foremost a clown.  So, as a result, I deem it necessary, in the interest of educating the people, to show what a crap spouting buffoon he really is.

In the interview, which you can see here. MSNBC's Chris Matthews decided to try to tear into the Nebraska Attorney General regarding the constitutional challenge to the health care bill.  Here is my assessment of Mr. Matthews shortfall on this topic

Mr. Matthews decided to use the Emergency Medical & Treatment Act of 1985 as an example of why the health care law is constitutional.  Here's why this was a huge mistake to use as an example:

This was a nice little twist of words, and slight of hand by Chris Matthews. However, here is the history on that for those that are interested. The Act he referred to, was constitutional, because it fixed a situation where people were dying during transport to "public" hospital. This was constitutional it only applies to hospitals that ... See Moreparticipate in the medicare program (an already federal program). Private hospitals that did not participate in medicare are actually only responsible to stabilize the patient enough to transport to a medicare participating hospital. Health care is considered to be unconstitutional, one because it violates the inter-commerce guarantees, and two, because it forces every citizen from birth, to purchase a "product". Make no mistake, insurance is a product, when it comes to commerce.Too bad Chris Matthews didn't do ALL of his homework when referencing this act. Interesting side note to the passage of the act he referenced, in 1985, the republicans controlled the senate, and the democrats controlled the house. This bill passed the senate by a FAR larger margin than it did in the house.

When lies are the only defense of a bad bill, it's probably better to be quiet.

Well, here we are.....

Well folks, here we are.  Health care has passed, and the sleeping giant which is the American people realized they slept in just a little too long.

Beyond the rhetoric, and all of the anger that we all feel, I have intentionally waited to post a blog on this topic following the vote, in order to reflect for a bit, and see what it is exactly that brought the US to a point where it could fall as it has.

While I love this nation, and all of the people in it, I have come to the realization that living in a nation of pacifists, is not necessarily a good thing.  Yes, we the people will fight when we have to.  Yes, we the people will make our voices heard.  Unfortunately, the sad truth of it is, though, that we only fight after we have nearly been stabbed to death, and that we only scream to make our voices heard when we can no longer do anything else, and have no other choices, because we are powerless to stop the injustice that is impending.

I am going to go on record, and say that we, as a nation, are lost unless we find the voices that our predecessors had when they founded this great nation.   The fact is, that the extreme loss of freedom that occurred last night, truly happened when we put our heads in the sand and allowed these people to get elected in 2008.  It was then, and only then, that we should have been adamant about making our voices heard.  It is up to us, to educate our children, and ensure that they understand the democratic process that controls this republic we live in.  This nation suffers from a severe lack of education on how our government works, and the ideals that it was founded on.  We must, as a nation, begin to educate our young people in the difference between rights and freedoms, compared to dependence and entitlements.  We MUST teach our children that the effect of getting an entitlement, is a loss of freedom.

Our young people that have been educated in the last 12 years or so, were never taught  basic civics the way most of the older generations were.  They, unlike us, were indoctrinated into what the government can do for you, and not what you can do for yourself.  President Obama, in his victory speech last night, said that this legislation will enable more Americans to pursue the American dream.  I submit for review, that people only accept this, because they do not understand what the American dream was built to be.  Our children have been raised to believe that they are entitled to have everything handed to them, and do not think they truly have to work for anything to make it in this life.  It is on US, the PARENTS, to ensure that our children understand the reality of what their teachers, and the media are telling them they should expect out of life.  It is on US to educate our children, neighbors, and family members that you NEVER get something for nothing.  Anything the government promises you, that they say is your right, that they will happily manage for you, always comes at a price.  Whether that price is freedom, or your hard earned paycheck, (usually both!) there is always a price, and that price is usually entirely too high.

As of today, I vow to dedicate this blog to that education.  I now dedicate myself to doing all that is possible to eradicate the apathy that is now the United States.  I vow to do whatever I can, whenever I can, no matter how small of an impact it may seem to make, to remind my fellow Americans what this great nation was founded on, and how far from that we have strayed.

I challenge everyone that reads this, to take up the same flag, and to remind those close to you, that you never get something for nothing.  The price paid, may be your paycheck, it may be your job when your employer can no longer afford to pay you because the government is taking all of their money, it may be your ability to choose whether you want insurance or not, or it may, in the not so distant future, be your right to fight a disease to live, when the government says you are a hopeless case, and too expensive to be worth the effort.

Always remember my friends, freedom is never free.  You have to work for the things you want, and earn your freedoms.  You also will constantly have to fight against those that do not want to work for the things they have.  They will do all that is in their power, to gain what you have worked so hard to get, just so they don't have to wait for it.  This is redistribution of wealth, no matter what the form.  It is socialism, and it is completely contrary to the principals this country was founded on.

I'm going to close this out for now.  I implore all of you that read this blog to consider my words, and make whatever small change to the mindset of the nation you can make.  Please post your thoughts on this, I'd love to hear them

1 million jobs saved or created..... yeah right!

So, I sit here today reading the news.  I cannot get over how our president has an affinity for pulling numbers from places where the sun doesn't shine.  In this article Obama the job savior our narcissistic president claims that he has created or saved 1 million jobs via the porkulus bill.  I don't know about the rest of you, but, it seems to me that with an additional 3 million jobs lost since the porkulus bill, that all he really managed to do, was to shift the jobs of 3 million hard working Americans to job areas that would typically support his radical agenda items. (aka, Education, etc.)  Now, especially given the fact that less than 1/6th of the billions of our dollars that congress snagged onto have been spent, I don't honestly see how the president can claim he's done anything.  I am more inclined to believe that enterprising business people have rather done a good job of finding ways to keep people employed regardless of the brick wall of government that is trying to fall on them and bury them alive.  Even as president Narcissist, and his group of sycophantic suck-ups in congress continue to try to limit the ability of business, small business in particular, to create jobs, let alone operate, these hardy individuals continue to try to improve their business climate (and thereby our economy), only to have president Narcissist take the credit for it.  I am getting truly tired of a president that is more interested in his own socialist agenda, and more importantly, his narcissistic addiction to the lime light, than actually using the brain he has that all of the libs say is SOOOO intellectual, and figuring out that he is single handedly killing this nation.  Of course, my own personal opinion is that this has been the goal from the beginning.  With president Narcissist, it has been one crisis after another, that just MUST fix.  Don't forget people, that during the 2008 campaign, both president Narcissist and Hilary Clinton made the same statement.  That statement was "never waste a good crisis"  Do some research, you can find the sound bites on youtube.

Anyone that thinks that these people have our best interest at heart, and only want to help America are deluding themselves.  This administration, and the congress and senate that support him are only looking for one thing.  The next step they can take to take away more of your freedoms.  I would like to say that I have hope that their super majority will be torn to shreds in 2010, however, the problem with that statement, is that by then, I fear, it will be too late, and they will have already torn much of what America stands for down to nothing but rubble.  Why do you think they are moving at break-neck speed to pass all of this new big government legislation.  It's because they realize that the American people are waking up and speaking their minds about not wanting it, and they know that if they don't take your freedoms from you now, that they might not get the chance again for another decade or so.

We, as the American people, need to continue and accelerate this awakening we have begun.  It is time to send a message to all of our leaders that this simply must stop.  Our founding fathers tried to ensure that we would always be free.  Unfortunately, over the centuries, we the people have allowed our government to bend the rules here, twist the words there, until finally, we are left with a president that feels it his duty to destroy the constitution he swore to uphold.  We need to stand up America.  Be counted and be heard!  Don't sit idly by and watch our nation crumble.  It takes all of 30 seconds to send an email to you congressional and senate representatives.  Make your voice heard!

Health care debate

    

Let me begin this blog post by stating how I really feel about this topic. “What health care debate?!?”

This so called health care debate is simply laughable. There is absolutely NO debate going on. What is happening is a balancing act between railroading larger government down our throats without the politicians sacrificing their precious re-election! Speaking of that, quick sidebar, I have to say that I really wish Olympia Snowe would just change party affiliations. She is nearly as leftist as Barney Phife, oops, my bad, I mean Barney Frank. OK, back on topic. This railroading of the American people is simply embarrassing. That we, the American people will simply sit by and allow this to happen without raising a holy stink about it is a sad state of affairs. Let’s dig into this proposed legislation a little and evaluate some of the causes and effects.

CAUSES:

I don’t know about other states, but, in Colorado, hospitals cannot refuse health care to ANYONE. So, what then is the crisis here. Oh yeah, I remember what the crisis is. This so called crisis, for those that haven’t been able to put two and two together, was largely created by the government themselves. By forcing Medicaid and Medicare down the throats of the doctors and hospitals, and determining on their own what they were going to pay them, the same doctors and hospitals had to raise their rates to OUR insurance companies to compensate for the losses. Neat trick to raise the rates, and artificially inflate health care costs so they can claim their crisis and execute this enormous land grab for larger government. Have you all noticed that they are VERY careful not to mention what a mess they have made of the Medicaid and Medicare systems? God forbid that we should remember what a mess they make out of anything they control before they can ram it down our throats. Make no mistake, they could care less if you remember that after the fact, as you watch you quality of care go downhill. They could care less, because they have already gotten the power they were after. Additional causes for this so called crisis are all related to the legislation I referred to above that makes doctors and hospitals treat everyone, whether they have coverage or not. This additional factor, is that, as badly as Medicaid and Medicare have inflated costs, the cost of treating Illegal immigrants, that cannot be refused care, is even worse. These people have no intention of EVER paying that doctor or hospital for their care. So, who pays for it then. Oh yeah, us. The tax payers are already footing the bill for free care. In addition to all of this. I want everyone to think back, even just a year ago. Do you realize that nobody even knew this was a problem until we were told that it was a crisis? Now, the American people are SO inundated with talk about this crisis, that the sheep are falling into line, and admitting to themselves that there MUST be a crisis since everyone is talking about it. People, there is NO CRISIS. Look at facts, not the media hype! Do your research! Think for yourself! All people in the U.S., whether they are citizens, or illegal, can go to a hospital right now and get treated for what ails them. If they tell the doctor at said hospital that they can’t afford whatever prescription the doctor gives them, the hospital will give them the medication for free. So, why exactly does it matter if they have a government run health insurance card or not. Oh yeah, that’s right, because the true crisis is that the libs need an excuse to tax the hell out of you some more. Speaking of taxes, let’s get on to the effects shall we?

EFFECTS:

From an average guy’s perspective, working for a good corporation:

I work for a large D.O.D. contractor on an Air Force base. I make a decent (although probably enough for a left wing nut to want me to provide for 2 illegal families) living, and I have a good health care plan. Now, according to this new legislation, shame on me for being able to have a good health care plan, and not wanting the government to ration my health care. So, since I’m such a horrible person, and don’t need their subsidized health care, I will now be taxed on my health insurance, so I can provide health care for 5 other individuals, that probably don’t even deserve it. How on earth does anyone in their right mind rationalize this into being something that should happen in the land of the free and the home of the brave.  So much for freedom, I get to be taxed for being responsible and paying for my own health insurance. Like I need to pay any more taxes.

From a small business owner’s perspective:

As a small business owner, with only part time employees, I will now be required, not to offer, but, to PAY FOR, health care for all of my employees. As I said before, the business is a bar, and I have five part time bartenders. Now, what that means for me and my employees, is that there is absolutely NO WAY, I can afford to pay for health care for five part time bartenders. Thanks to the taxes I already have to pay, I still have to have a full time job to support myself and the bar, as does my partner. So, the end result is that I will have to sit down with my employees, and let them know that from this day on, I can only afford to have 2 full time employees, and will most likely do much of the weekend bartending on my own. End result: my small bar has just had to cut three employees, just so I can afford to be compliant with the new health care law.

Effects summed up:

The business owners are going to have to cut jobs to provide the health care required by us to provide. That is going to lead to even HIGHER unemployment. The responsible people that have jobs, and pay for their health insurance like they are supposed to, will then be taxed for taking care of themselves, so that the government can pay for the health care needs of the employees I had to let go because I couldn’t afford to keep them employed. NEAT SYSTEM HUH?!? Boy, isn’t the government efficient! Of course, don’t forget, you can always avoid those nasty taxes, if you just bend over and take the government run health plan where the sun don’t shine so THEY can get your money instead of the health insurance firms. Man, it’s a good thing their leaving our power of choice in tact huh?

Well, that will about complete my rant on this topic. I bid you all well. I’m going to spend my evening looking for a part time job so I can afford the taxes on my health insurance plan.

It is my hope that this will be passed on to all of the health crisis lemmings, so that maybe some of them will think for themselves.

   Welcome to my blog!  My name is Quentin Sachse.  Over the weeks, months and years, I'll be posting my thoughts on the current political climate, and issues, as well as my own personal messages to our leaders, and the constituents they are SUPPOSED to be serving.
 
  I hope that as these posts develop, that they will be worthwhile reading for everyone, and that maybe, just maybe, I can jog thought into action in this country.  It's not much, but, it's a start, in trying to get the average American to stop worrying about what is being done to us by our leaders, and encourage people to start fighting for what is right.
